1. Acceptance of these Terms
These Terms of Use (“Terms”) govern your use of the Avelina’s Art website, services and products (the “Service”), operated by Avelina’s Art LLC (“Avelina’s Art,” “we,” “us”). By creating an account, uploading artwork, or placing an order, you agree to these Terms and to our Privacy Policy, which is part of these Terms. If you do not agree, do not use the Service.
Last updated: October 15, 2026
2. Who may use the Service
The Service has two kinds of account holders, and no others:
- Teachers — teachers, aides, administrators and other staff of a school, district, camp, studio or similar program (each a “School”) who photograph and upload student artwork and share it with families.
- Parents — a student’s parent or legal guardian (a “Parent”) who views their child’s artwork and orders keepsake products featuring it.
You must be at least 18 years old to create an account or place an order. Children do not have accounts, cannot log in, and cannot upload, view or buy anything through the Service. Students appear only as the creators of artwork that a Teacher has uploaded.
The Service has no public gallery, profiles, comments, messaging, fan clubs or other community features. Artwork is never displayed publicly; it is visible only to the uploading Teacher, authorized School staff, and the Parent(s) connected to that student.
3. Accounts and access
Account information. You agree to give accurate, current and complete information when you register and to keep it up to date. You may register only for yourself, may not impersonate anyone, and may not share or transfer your account. Keep your password confidential and tell us right away at support@avelinasart.com if you suspect unauthorized use. You are responsible for activity under your account.
Additional terms for Teachers.
- Authority. You confirm that you are a current employee or authorized staff member of your School and have any approvals your School requires to use the Service with students. When your role at the School ends, you must stop using your account for that School.
- Student roster. To organize artwork you may enter each student’s first name and, optionally, last initial and grade or class. Do not enter full last names, dates of birth, student ID numbers, photos of students, or other identifying details.
- Parent invitations. Each student is assigned a unique access code or invitation link. You are responsible for delivering it only to that student’s Parent(s), using your School’s normal family-communication channels. If your School authorizes you to give us Parent email addresses, we will send the invitation directly.
- Notices and consent. You are responsible for following your School’s policies on sharing student work with families and for giving any notices your School requires. Artwork is not visible to a Parent until that Parent accepts the invitation and agrees to these Terms.
Additional terms for Parents.
- Connecting to your child. You connect to your child’s artwork using the code or link provided by the Teacher. You confirm that you are the child’s parent or legal guardian and are entitled to view the child’s school work.
- Your consent. By connecting, you consent to Avelina’s Art storing your child’s artwork and the limited roster details above so you can view it and order products. You may withdraw consent at any time (see Section 5).
- Shared custody. More than one Parent may connect to the same child. If a court order limits another person’s access to your child’s records, notify the Teacher and us and we will help remove that connection.
4. Artwork: uploading, sharing and ownership
Who owns the artwork. The student (through their Parent) keeps all ownership rights in the artwork. Avelina’s Art claims no ownership.
Teacher uploads. Before uploading, Teachers agree to review each image and remove, crop or mask anything that identifies the student or others, such as a full name, school name, address or a person’s face. Teachers may upload only artwork created by their own students in their program, and confirm they are authorized by the School to do so.
Limited license to us. To run the Service, the uploading Teacher (on behalf of the School) and the connected Parent each grant Avelina’s Art a limited, non-exclusive, royalty-free license to store, copy, display to authorized users, resize, color-correct, crop and adapt the artwork, and to share it with our production and fulfillment partners, solely to (a) show the artwork to the Teacher and connected Parents and (b) produce and ship products a Parent orders.
What we will not do. We will not display artwork publicly, sell products featuring a child’s artwork to anyone other than that child’s connected Parent(s), or use artwork, student names or images in our marketing, unless the Parent gives separate, written opt-in permission.
Removal. A Parent or Teacher may ask us to delete any artwork at any time through their account or at support@avelinasart.com. The license ends when the artwork is deleted, except for copies needed to finish orders already placed and backups kept for a limited period under our Privacy Policy.
5. Children’s privacy
We never collect information directly from children; it comes only from Teachers and Parents. We handle student information in line with the Children’s Online Privacy Protection Act (COPPA), the Family Educational Rights and Privacy Act (FERPA) where it applies, and applicable state student-privacy laws, as described in our Privacy Policy.
- We use student information only to provide the Service and fulfill Parent orders.
- We never sell or rent student information, and never use it for advertising of any kind.
- A Parent may review, correct or delete their child’s information, or withdraw consent, at any time by contacting support@avelinasart.com; we will then stop using it and delete it, except as needed to finish orders already placed or as required by law.
- A School may ask us to delete its roster and artwork at any time.
If your School requires a signed student data privacy agreement, contact us at support@avelinasart.com. If one is signed, it controls over these Terms where they conflict.
6. Orders, approval, shipping and replacements
Who may order. Only a Parent connected to a child may order products featuring that child’s artwork. Orders are placed through our checkout, and payment is processed by our third-party payment provider; we do not store full card numbers.
Design approval. Every product is made to order. After checkout we send a design proof for review. Production begins only after you approve the design, by email or by phone. Once approved, the design is final, so check the artwork, product, size, spelling of any added text and shipping address carefully.
Image quality. Products reproduce the image the Teacher uploaded. We may adjust color and cropping for print, but we cannot improve a low-resolution, blurry or poorly lit photo beyond what it shows. A product that faithfully matches the approved proof is not defective.
Prices, taxes and shipping. Prices are shown at checkout in U.S. dollars and may change before you order. Applicable sales tax is added at checkout. Orders under $100 are charged carrier-calculated shipping shown at checkout; orders over $100 will receive FREE GROUND SHIPPING, deliveries in 10-14 business days. Production and shipping timelines are stated in business days and are estimates, not guarantees.
Defects and replacements. If a product arrives damaged, defective, or does not match the approved proof, email orders@avelinasart.com within 15 days of receipt with your order number and photos of the issue. We will replace the item at no charge.
All sales are final. Because each item is custom-made, we do not offer refunds, returns or exchanges, including for approved designs, apparel size choices, or a change of mind. Nothing in this section limits any rights you have under laws that cannot be waived.
7. Acceptable use
You may use the Service only to upload and share student artwork (Teachers) and to view and order products featuring your own child’s artwork (Parents). You agree not to:
- upload anything other than student artwork, including photos of children, personal documents, or content that is obscene, violent, hateful, harassing or harmful to minors;
- upload artwork you are not authorized to share, or that infringes anyone’s copyright, trademark, privacy or publicity rights;
- access, or try to access, another family’s artwork or account, or share an access code with anyone other than the intended Parent;
- download, copy, resell or commercially use artwork or products except for your family’s personal use;
- use bots, scrapers or other automated tools, upload malicious code, probe our security, or interfere with the Service;
- misrepresent who you are or your relationship to a School or child.
We will report any suspected child sexual abuse material to the National Center for Missing & Exploited Children and law enforcement. We may remove content and suspend or close accounts that violate this section.
8. Our intellectual property
The Service, including its software, design, text, logos and the Avelina’s Art name, belongs to Avelina’s Art or its licensors. These Terms give you a limited, personal, revocable right to use the Service as described here and no other rights. You may not copy, modify, reverse-engineer, resell or build a competing product from the Service.
If you believe content on the Service infringes your copyright, send a notice to, by mail: Avelina’s Art LLC 94 Van Liew Ct, East Brunswick, J 08816 or email info@avelinasart.com , and we will respond under the Digital Millennium Copyright Act.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” EXCEPT FOR THE REPLACEMENT COMMITMENT IN SECTION 6, AND TO THE FULLEST EXTENT THE LAW ALLOWS, AVELINA’S ART DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND DOES NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
10. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, AVELINA’S ART WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOSS OF DATA OR PROFITS. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $100. SOME STATES DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.
11. Indemnity
To the extent your state’s law allows, you agree to defend and hold harmless Avelina’s Art and its owners, employees and service providers from third-party claims arising from your breach of these Terms, content you upload, or your violation of law or someone else’s rights. This section does not apply to public Schools or their employees to the extent their governing law prohibits indemnification.
12. Suspension and termination
You may close your account at any time by contacting support@avelinasart.com. We may suspend or close an account that violates these Terms. When an account closes, we delete its artwork under our Privacy Policy, except as needed to complete open orders or comply with law. Sections 4 (removal), 6 (sales final), and 8 through 14 survive termination.
13. Governing law and disputes
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Middlesex County, New Jersey, and you and we consent to that jurisdiction.
14. Changes and general terms
We may update these Terms. We will post the new version with a new “Last updated” date and, for material changes, notify account holders by email. Changes take effect when posted, or 30 days later for material changes affecting how student information is used. Continued use after that means you accept them.
These Terms, the Privacy Policy and any signed School data agreement are the entire agreement between you and us. If any part is unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger or sale of the business. We are not liable for delays caused by events beyond our reasonable control.
